for the myvanspot project

(hereinafter referred to as the "Operator")
1. Introductory Provisions
1.1.
The Operator operates an advertising portal (the "Portal") at www.myvanspot.com (the "Website"), enabling third parties ("Providers") to offer their services to others ("Seekers"). Users can interact legally through the Portal, specifically entering into service agreements ("Mediated Agreement") and processing payments. The Portal is also available via the "myvanspot" mobile application.
1.2.
These Terms and Conditions ("T&C") govern the mutual rights and obligations between the Operator and Users arising from the User Account Agreement in accordance with Section 1751(1) of Act No. 89/2012 Coll., Civil Code.
1.3.
The User Account Agreement, including the T&C, is drawn up in the Czech language; this English version is provided for international communication purposes.
2. Definitions
2.1.
Exclusive Reservation: A condition where the Land is rented as a whole, and the Provider will not offer it to third parties during the term.
2.2.
Code: The "myvanspot Code of Ethics" available on the Website, defining rules of conduct for Users.
2.3.
Payaut B.V.: The payment gateway provider facilitating the transfer of fees and remuneration.
2.4.
Fee: The commission paid to the Operator for portal services according to the Price List.
2.5.
Provider: A User offering Services (land lease, vehicle rental, or accommodation).
2.6.
Service: Performance provided by the Provider (land lease, vehicle rental, or accommodation services).
2.7.
Vehicle: A vehicle intended for camping (motorhomes, caravans, vans, etc.).
3. User Account Agreement
3.1.
Proposal: A User submits a proposal by registering on the Website or in the myvanspot Mobile App.
3.2.
Formation: The agreement is concluded upon confirmation of registration by the Operator.
3.3.
Accuracy of Data: Users must provide correct data and update it immediately upon any change.
3.4.
Start of Performance: The User agrees to immediate performance upon conclusion. Pursuant to Section 1837 of the Civil Code, the User loses the right to withdraw if performance has already begun.
4. User Account
4.1.
Security: Access is protected by email and password. The User is obliged to protect these credentials.
4.2.
Blocking: The Operator may block an account if the User violates the agreement, law, Code, or fails to cooperate with AML identification.
5. Portal Services
5.1.
Providers may offer Services via their account. The Provider represents that they hold all necessary permits and fulfill obligations towards consumers.
5.2.
Operator’s Role: The Operator provides only the technical platform. The Operator is not a party to Mediated Agreements and is not liable for their fulfillment.
6. Service Provision and Payments
6.1.
Services are always provided by the Provider, not the Operator.
6.2.
Liability: The Operator does not verify the technical condition of Vehicles or the suitability of Land. Any claims must be made by the User against the other party to the Mediated Agreement.
6.3.
Payments: Processed via Payaut B.V. The Operator’s Fee is deducted from the remuneration before payout.
7. Conclusion of Mediated Agreements
7.1.
Agreements can be concluded via "Approval Mode" (Provider's confirmation) or "Instant Booking."
7.2.
The Operator informs both parties of the conclusion via email, including a unique Contract ID.
8. Further Obligations
8.1.
Conduct: Seekers must follow the myvanspot Code and maintain order and cleanliness.
8.2.
Taxes and Registration: The Provider is solely responsible for paying all taxes and local fees and maintaining legal records of guests.
8.3.
Non-Circumvention: Users agree not to enter into agreements outside the Portal for 1 month following the first contact on myvanspot.
9. Operator’s Fee
9.1.
The User pays a commission for mediation according to the Price List. The Fee includes VAT.
10. Licensing
10.1.
By uploading content to the Portal, the User grants the Operator a free, worldwide, perpetual license to use such content for the operation and promotion of the myvanspot brand.
11. Reviews
11.1.
Users may rate Services and other Users to ensure the quality of the myvanspot network.
12. Consumer Provisions
12.1.
Out-of-court dispute resolution is handled by the Czech Trade Inspection Authority (adr.coi.cz).
12.2.
The Operator's liability for digital content defects is governed by Section 2389g et seq. of the Civil Code.
13. Data Protection
13.1.
Processing of personal data is governed by the Privacy Policy in accordance with GDPR.
14. Duration and Termination
14.1.
The agreement is for an indefinite period. It may be terminated with a 30-day notice or immediately by deleting the User Account.
15. Delivery
15.1.
Communication is conducted electronically via the email address specified in the User Account.

16.1.
Ranking is influenced by popularity, ratings, and availability. Internal complaint system: www.myvanspot.com.

17.1.

18. Business Users (B2B)
18.1.
The Operator's liability towards business users for damages is limited to the amount of commission paid in the previous month, but no less than 100 CZK.
18.2.
The Operator may use the business name as a reference for marketing purposes.
19. Final Provisions
19.1.
Relations are governed by Czech law. Any disputes shall be resolved by the competent courts of the Czech Republic.
19.2.
The Operator may unilaterally change the T&C with 15 days' notice.
