PRODUCT TERMS AND CONDITIONS FOR LAND RENTAL
1. LAND AND ITS OFFER
1.1.
The Provider offers Land on the MyVanSpot Portal through electronic means by filling in the Land details in the relevant form within their User Account and submitting these details to the Operator by clicking the "Offer" button. Land details include uploading photographs of the Land; by making the offer, the Provider expressly authorizes the Operator to use the photographs for the purposes of the services provided for the entire duration of the User Account Agreement.
1.2.
If the Provider offers only a part of the Land for temporary use (i.e., typically when the capacity for Interested Parties is greater than one), they shall specify the individual parts of the Land in the offer (e.g., via an indicative map); this does not apply to Land offered under Mode C according to Art. 2.5 of these Product Terms. For the avoidance of doubt, the Provider remains responsible for the due fulfillment of all Rental Agreements concluded in relation to this Land.
1.3.
In the event of any change to the Land information provided in the offer form (Art. 1.1), the Provider is obliged to update the Land details immediately. A breach of this obligation is considered a material breach of the Provider's obligations.
1.4.
The Provider is entitled to offer for temporary use for a fee on the MyVanSpot Portal only Land that is eligible to be the subject of a Land Rental Agreement and where nothing prevents its use by the Interested Party for the agreed purpose (camping). In this context, the Provider specifically declares that:
1.4.1.
The Land is in their ownership or they have another right of use (e.g., a lease agreement, etc.);
1.4.2.
Providing the Land for temporary use for a fee is not hindered by any legal or other regulations, nor by any contractual or other arrangement with a third party or any third-party right;
1.4.3.
The Land is suitable for camping, and camping on the Land does not pose an increased risk of personal injury or damage, particularly due to the condition of the Land or adjacent properties;
1.4.4.
Camping on the Land is not hindered by any legal or other regulations, nor by any contractual arrangement or third-party right;
1.4.5.
The Land is eligible to be the subject of a rental agreement; and
1.4.6.
The Provider holds all public law authorizations necessary for renting out Land.
1.5.
If any of the above declarations by the Provider prove to be false, it shall be considered a gross breach of the Provider's obligations under the User Account Agreement.
1.6.
The Provider is solely responsible for the selection of the Land to be offered on the MyVanSpot Portal. This does not affect the Operator's rights under Art. 1.7 and 1.8 of these Product Terms.
1.7.
The Operator is not obliged to accept the Land offer for publication on the MyVanSpot Portal. The Operator reserves the right to make the final decision on which Land will be published and may choose not to publish Land in cases specified in Art. 4.5 of the Business Terms and Conditions.
1.8.
The Operator reserves the right to remove any Land offer from the MyVanSpot Portal in cases specified in Art. 4.5 of the Business Terms and Conditions.
2. OFFER MODES
2.1.
When submitting a Land offer under Art. 1.1, the Land is automatically offered in the Exclusive Partnership mode (Mode A). The Provider may subsequently manually request a change of the offer mode following the procedure in this Article 2.
2.2.
The Provider may request a change of the selected mode within their User Account once every 3 months. The change becomes effective 14 days after the request is submitted. The mode can also be changed based on an individual agreement between the Provider and the Operator.
2.3. Exclusive Partnership (Mode A)
2.3.1.
In this mode, the Provider must not offer or rent the Land to third parties outside the MyVanSpot Portal. The Provider may only rent the Land using the Portal. This commitment lasts for the entire duration of the User Account Agreement.
2.3.2.
If the Provider enters into a rental or similar agreement regarding the Land outside the MyVanSpot Portal, or offers such an agreement outside the Portal, it is considered a material breach. In such cases, the Operator may block the Provider's User Account in accordance with Art. 4.5 of the Business Terms.
2.3.3.
In the offer on the MyVanSpot Portal, the Land is marked with the "exclusive cooperation (A)" tag.
2.3.4.
Mode A Land is displayed at the top of the listings (always before Mode B and C Land).
2.3.5.
Special incentive conditions determined by the Operator may apply to Mode A Land.
2.4. Non-Exclusive Partnership (Mode B)
2.4.1.
In this mode, the Provider is entitled to offer and rent the Land to third parties outside the MyVanSpot Portal.
2.4.2.
Within the Portal offer, however, the number of persons to whom the Land can be rented is limited (maximum capacity). If a rental agreement is concluded outside the Portal, reducing the free capacity, the Provider must immediately update the capacity information via the User Account. The Provider is fully responsible for the due fulfillment of all agreements concluded both via the Portal and independently.
2.4.3.
The Land is marked with the "non-exclusive cooperation (B)" tag.
2.4.4.
Mode B Land is displayed after Mode A but before Mode C.
2.5. Non-Exclusive Partnership (Mode C)
2.5.1.
In this mode, the Provider is entitled to offer and rent the Land to third parties outside the MyVanSpot Portal.
2.5.2.
There is no limit on the number of persons for the Portal offer, and capacity is not displayed. The Provider must regularly check the remaining capacity; if capacity is reached, they must immediately inform the Operator or withdraw the Land from the offer.
2.5.3.
The Land is marked with the "non-exclusive cooperation (C)" tag.
2.5.4.
Mode C Land is displayed at the bottom of the listings.
